Hear from construction law attorneys regarding the implications of the November 2012 decision of the State Supreme Court in State v. Lombardo Brothers Mason Contractors and legislative efforts to level the playing field. The Court found that the doctrine of nullum tempus occurrit regi (no time runs against the king) is well established in Connecticut common law, exempting the State from the operation of any statutes of limitation or repose, and from any contractual time limitations on bringing suits. In so doing, the Court allowed the State to continue pursuing claims against contractors, design professionals, and others for alleged defects in the design and construction of the UCONN Law School library in a lawsuit begun 12 years after the project was completed.
